“Right to Request Flexible Working” : une mesure de conciliation travail-famille pour les parents et les travailleuses proches-aidantes ?

Abstract
Les initiatives récentes en matière de conciliation travail-famille pour les proches-aidants montrent un fort intérêt pour une mesure d'origine britannique: le "Right to request flexible working arrangements", que l'on pourrait traduire comme suit: "droit de demander un aménagement flexible du temps de travail". On a vu ce droit apparaître en avril 2003 à travers l’Employment Act 2002 qui a donné aux parents, notamment aux parents d’enfants handicapés, et en fait surtout des femmes, la possibilité d’engager des procédures pour obtenir un aménagement flexible du temps de travail. À partir de 2007, ce droit a été étendu aux travailleurs ayant à s’occuper d’un adulte dépendant, toujours plus souvent des femmes que des hommes. On constate que ce modèle tend à s'exporter, de plus en plus d'États songent à se l'approprier et on le voit déjà figurer dans certaines législations, notamment australiennes et néo-zélandaises. On peut citer comme témoin du succès de ce "Right to request" les récentes mesures adoptées par la ville de San Francisco, qui déclare explicitement s'inspirer de ces pays pionniers pour la création d'une nouvelle loi garantissant aux employés proches-aidants des horaires de travail flexibles et prévisibles. Dans ce contexte, la question sous-jacente de notre communication consiste à se demander si l'instauration d'un "Right to request" serait pertinente pour les travailleuses proches aidantes au Québec et, le cas échéant, sous quelle forme celui-ci devrait être élaboré.
