Les conventions interamericaines n’ont pas eu une forte influence sur la legislation nationale des pays de la region et sur leurs activites pour combattre la traite. La force et l'efficacite des dispositions des conventions interamericaines pertinentes dependent manifestement du nombre des adhesions dont elles font l'objet et des mecanismes mis en place pour en controler l'application. Les problemes sont multiples sur les deux fronts : un nombre peu eleve de ratifications pour l’un des traites; et des mesures d’execution faibles ou inexistantes pour les deux autres. L’analyse commande donc la conclusion que les traites interamericains ne jouent pas un role d’avant-garde dans la lutte contre la traite des femmes et des enfants dans les Ameriques et les Antilles. De fait, dans la region, l’impulsion la plus importante ne provient pas du cadre juridique interamericain mais d’une legislation antitraite americaine. Or si, dans ce chapitre, nous constatons que les sanctions economiques envisagees dans la legislation americaine constituent une force plus contraignante que les normes juridiques des conventions regionales, nous y soulignons egalement que cette approche tend a favoriser les interets americains et qu’une lutte plus holistique contrerait plus efficacement la traite des femmes et des enfants dans les Ameriques.Inter-American human rights treaties have not had a strong impact on the legislation and policies of countries of the region when it comes to their activities to combat trafficking. The strength and effectiveness of the relevant inter-American conventions clearly depends on the number of ratifications and the enforcement mechanisms established to monitor their implementation. Problems exist on both fronts: few ratification for one treaty, and weak or non-existent enforcement mechanisms for the other two. This article concludes that inter-American treaties do not play a leading role in the fight against trafficking in women and children in the Americas and the Caribbean. In fact, in the region, the most important impetus for combating trafficking does not come from the Inter-American legal framework, but from anti-trafficking legislation in the United States. Indeed, the economic levers used by the U.S. to force States to deal with trafficking problems has a stronger impact than regional conventions. This approach, however, tends to favour U.S. foreign policy interests instead of creating a holistic and effective policy to counter the problem of trafficking of women and children in the Americas.
