Abstract
This article examines thoroughly what is done and sketches the furrows of what could be done in the process of relocation in third countries of those acquitted by international criminal tribunals. By carefully analysing instrument by instrument, it considers whether third States are legally obliged to receive these acquitted persons in their territories. Starting with what is done, it illustrates various but unsuccessful endeavours of relocation based on the non-exhaustive areas of cooperation enshrined in the ictr statute, the Residual Mechanism, and the Rome Statute before closely discussing the binding nature of the Security Council resolutions adopted in this regard. As for what could be done, the article addresses the intricate and complicated entanglement between exclusion clause in refugee law and presumption of innocence both in terms of standard of proof and modes of participation necessary for exclusion from refugee protection in four countries chosen by the acquitted themselves.
