Depuis les années 80, le recours aux techniques dites contractuelles est apparu selon des degrés divers comme une alternative possible en matière de gouvernance publique. Face aux tentatives de privatisation de certains ou de décentralisation d’autres, la contractualisation s’est présentée comme une des ouvertures au modèle de nouvelle gestion publique (NGP). En effet, que ce soit en Belgique, en France , au Québec, au Danemark, en Allemagne, aux Pays-Bas ou encore en Angleterre, ce type de démarche s’est répandu avec, à chaque fois et malgré quelques spécificités nationales relativement importantes,1 un fondement théorique commun : les relations entre l’Etat et ses organismes, établissements, institutions ou entreprises publiques ou dans certains pays, ses collectivités territoriales, sont de moins en moins dominées par des rapports de tutelle ou de contrôle classique mais davantage par un contrôle a posteriori sur les performances de celles-ci. L’idée principale réside donc dans la négociation d’un contrat où l’Etat assure une plus grande autonomie à l’administration et, « en échange », celle-ci s’engage à atteindre les missions de service public qui lui sont confiées avec un niveau d’efficacité et de performance prédéfini. Le contrat, négocié entre ces deux parties,sera soumis à évaluation des engagements qui y figurent.
