Dans ce texte, l'auteur examine la justification de l'interdiction du foulard islamique dans les ecoles, colleges et lycees francais, telle qu'avancee par la commission Stasi. Il soutient que le principal argument avance dans le rapport Stasi au soutien de cette interdiction est acceptable en principe. L'auteur se demande ensuite si le meme type d'interdiction serait justifiable au Canada. A cette fin, il reconstruit la position «canadienne» qui postule l'existence d'un droit fondamental a des accommodements raisonnables ou a des exemptions pour des motifs religieux dans les ecoles. Il rappelle que si cette position etait valide, elle exigerait une justification de l'interdiction beaucoup plus forte que celle avancee par la commission Stasi. Neanmoins, l'auteur critique cette position et montre qu'elle est mal fondee en principe. L'argumentation ne signifie pas que les ecoles peuvent moralement interdire les symboles religieux pour n'importe quel motif. Cependant, elle signifie que si des faits semblables a ceux qui soutiennent l'interdiction du foulard islamique en France existaient au Canada, on ne pourrait opposer l'existence d'un droit fondamental a des accommodements raisonnables a l'ecole pour des motifs religieux a la decision politique d'interdire ce symbole religieux dans les ecoles. Enfin, l'auteur maintient qu'une decision recente de la Cour d'appel du Quebec qui portait sur le droit d'un jeune eleve Sikh de porter son kirpan a l'ecole appuie sa these principale.
