Les poursuites engagees contre Louis Auger, le depute federal le plus jeune au Canada, representent un episode retentissant et scandaleux de l'histoire de la justice canadienne. Accuse de viol sur la personne d'une jeune Franco-Ontarienne de 17 ans dans son bureau a la Chambre de communes, Auger a essuye la colere d'un groupe acharne de juges et de poursuivants anglophones. Au debut de du XXe siecle, les plaintes de viol portees par les femmes des classes laborieuses et appartenant aux minorites ethniques etaient rarement prises au serieux. Dans cette affaire extraordinaire, les autorites n'ont pas hesite a deroger aux presomptions, aux regles de droit et aux procedures habituelles, pour s'assurer de faire un exemple de ce depute, de ce parvenu d'etudiant en droit franco-ontarien qui, a leur avis, avait abuse de sa situation. Louis Auger est passe en jugement cinq fois, respectivement pour viol, seduction et parjure pour etre en fin de compte, reconnu coupable et condamne a deux ans d'emprisonnement au penitencier de Kingston. Le recit de ces poursuites met en lumiere l’interaction complexe des considerations de sexe, de classe sociale et les facteurs ethnolinguistiques, tels qu'ils influaient sur l'application des regles de droit en matiere d'agression sexuelle dans cette affaire celebre et controversee. The prosecution of Louis Auger, Canada's youngest Member of Parliament, constitutes an explosive and scandalous moment in Canadian legal history. Charged with raping a seventeen-year old Franco-Ontarian woman in his room in the House of Commons, Auger faced the wrath of a determined group of Anglophone prosecutors and judges. Working-class women from ethnic minority groups who complained of rape in the early twentieth-century rarely found their complaints taken seriously. In this unusual case, the authorities were prepared to alter customary assumptions, legal rules ad procedures to ensure that they made an example of the M.O. They viewed as an upstart Franco-Ontarian student-at-law, who had abuse his office. Louis Auger faced five trials for rape, seduction and perjury before he was ultimately convicted and sentenced to two years in the Kingston Penitentiary. The narrative of the prosecution reveals the complex interplay between gender, class, and ethno-linguistic factors as they influenced the application of the law of sexual assault in this notorious and controversial proceeding.
