Abstract
Issu d'une thse soutenue en 2008 l'Universit de Mnster, l'ouvrage s'intresse une importante pratique pnale de l'poque moderne, employe surtout au niveau de la basse justice par les tribunaux ecclsiastiques : la pnitence publique ou Kirchenbue, autrement dit l'exposition du fautif, vtu d'un drap blanc et tenant un cierge allum dans la main, devant les portes de l'glise l'intrieur de laquelle la communaut des croyants assiste l'office. En se fondant sur l'exemple des principauts-vchs de Mnster et d'Osnabrck, l'auteure se propose d'analyser cette sanction, dont la recherche a longtemps prtendu qu'elle avait disparu la fin du Moyen ge, sous l'angle de ses motivations sociales : fut-elle un acte expiatoire qui rintgre dans la socit ou bien un geste punitif qui en exclut ? L'tude vise pourtant plus loin. Soucieuse d'analyser la pratique concrte de la peine, C.D.S. s'interroge non seulement sur ses caractristiques, ses fondements normatifs ou les domaines de son application, mais elle entend galement l'inscrire dans le cadre plus large de l'exercice des pouvoirs judicaires au sein des territoires ecclsiastiques du Saint-Empire, et donc resituer sa place dans les interactions entre les sphres du politique, du religieux et du juridique qui, l'poque moderne, faonnent le social.
