Abstract
Au Quebec, des le milieu des annees 1950, dietetistes et physiotherapeutes avaient commence a negocier leur statut professionnel avec l’Etat. Cette negociation reprendra toute son importance avec l’adoption du Code des professions en 1973, alors que l’obtention d’une pratique exclusive ou d’un titre reserve en constitue le point majeur. Il s’agit la d’un aspect de la professionnalisation pour lequel l’Etat est devenu un interlocuteur incontournable, etant tout a la fois legislateur, arbitre et employeur. Nous verrons comment, dans le nouveau cadre legal instaure par l’Etat, se profilent des enjeux majeurs pour des occupations majoritairement feminines et dont le statut professionnel ainsi que l’autonomie sont encore fragiles. Toutefois, jusqu’a quel point le caractere parfois contradictoire des roles assumes par un Etat legislateur et employeur ne fournit pas a ces professions une certaine marge de manœuvre? Nous examinerons aussi le probleme des frontieres interprofessionnelles que pose aux dietetistes et aux physiotherapeutes leur revendication d’une pratique exclusive. Since the mid-1950s, dieticians and physiotherapists in Quebec had been negotiating with the State to obtain legal professional status for their respective fields. These negotiations became even more important with the passing of a provincial law in 1973 establishing a Professional Code. Among the major issues negotiated with the State were exclusive right to practice and reserved title. In this aspect of the process, the State became an inevitable participant, simultaneously playing the roles of legislator, arbitrator and employer. In light of the new legal structure instituted by the State, we shall look at the development of the major issues for these largely female occupations, whose professional status and autonomy are not yet firmly established. However, the sometimes contradictory nature of the State's roles as legislator and employer may, at some point, have provided these professions with a certain amount of leeway in their negotiations. We shall also examine the problem of inter-professional boundaries, which arises from the demands of dieticians and physiotherapists for exclusive right to practice.
