Os fluxos comerciais internacionais de bens culturais aumentaram consideravelmente nas últimas décadas, e sua liberalização tem se tornado um tópico sensível em negociações comerciais multilaterais, ultrapassando a esfera da OMC para entrar na redoma protetiva da UNESCO. Este trabalho analisa a história do debate comércio versus cultura a partir das perspectivas da OMC e da UNESCO, a fim de traçar seu desenvolvimento e estabelecer a necessidade de maior proteção aos bens culturais em sistemas comerciais. Para tanto, vale-se da análise de material primário e secundário, com a análise de julgados da OMC concernentes a bens culturais (Turkey Taxations, Canada Periodicals e China Audiovisuals) e a interpretações atuais (US Shrimp), e com o exame da Convenção da Diversidade Cultural, de maneira a apontar seus avanços e falhas na tentativa de equilibrar a dinâmica entre comércio e cultura. Outrossim, esta pesquisa aponta que, apesar da implementação de medidas de cooperação internacional, a Convenção não teve um impacto significativo no sistema comercial da OMC. Dessa maneira, sugere-se a necessidade de novas interpretações dos Acordos da OMC ou a inserção, neles, de uma cláusula de exceção cultural. Com isso, o comércio de bens de valor duplo – comercial e cultural, poderá ser considerado conforme suas especificidades, sem que se impeça sua circulação, tampouco seu desenvolvimento global.
