La présente thèse précise comment les deux espaces normatifs, national et international, ainsi que leurs institutions interagissent pour éliminer l'impunité des génocidaires, des criminels de guerre et des criminels contre l'humanité. Cette question se pose d'abord au niveau des législateurs nationaux où elle est évoquée en terme d'obligation internationale d'adapter le droit interne au droit international. Ensuite au niveau de's juridictions pénales nationales ou elle sous-tend la compétence ou l'incompétence du juge saisi d'une affaire ayant un élément d'internationalité. Et in fine, au niveau des juridictions pénales internationales pour qui "les lois nationales ne sont que de simples faits" dont la légalité doit être appréciée selon les normes internationales. Les exemples belge, canadien et rwandais illustrent l'existence de trois modèles d'intégration du droit pénal international en droit interne: le modèle d'intégration forte caractérisé par une compétence universelle absolue, le modèle pragmatique qui consacre la compétence universelle restreinte et le modèle divergent qui ignore la compétence universelle.
