Implementing Safety Management Systems (SMS) in Canada: Is Flight Safety on a Collision Course with the Forced Disclosure of SMS Data?

Abstract
In 2013, the International Civil Aviation Organization (ICAO) adopted Annex 19 to the Chicago Convention, a safety initiative which now requires commercial air carriers around the world to implement Safety Management Systems (SMS). In an effort to further reduce accident rates globally, SMS relies on the voluntary disclosure of safety incidents by airline personnel which should, in theory, allow carriers to proactively respond to organizational safety hazards and prevent accidents. This article identifies the potential legal shortcomings of SMS, with a strong emphasis on Canada’s experience as the first ICAO member State to fully implement Annex 19 across its commercial aviation industry. It examines how SMS data is vulnerable to forced disclosure by Canadian courts, a trend which currently endangers the industry’s Just Culture and will likely hinder the overall success of Annex 19. Drawing on recent Canadian case law, the article explores the legal challenges in protecting SMS information from disclosure in the public domain under access to information legislation or, worse, from being used against a carrier during trial. With airlines alarmed by the possibility of having their flight safety data sacrificed on the altars of litigation, this multidisciplinary analysis will bring forward legal and political solutions to afford confidential treatment to SMS data, which should allow Annex 19 to fully accomplish its theoretical objectives and prevent any setbacks in the current rollout of SMS universally.
