Abstract
Hintergrund: Seit dem „Hamburger Fall“ von 1894 gilt aufgrund eines Beschlusses des Reichsgerichthofes, dass jeder chirurgische Eingriff als Körperverletzung gewertet werden muss und nur im Falle der Einwilligung des Patienten straffrei ist (1). 1951 wurde diese Entscheidung vom Bundesgerichtshof übernommen (2). Eine ausdrückliche Aufklärungspflicht für Eingriffe in der Kinderheilkunde wurde in der „Deklaration von Ottawa zum Recht des Kindes auf gesundheitliche Versorgung“ erst 1998 festgelegt (3). Ziel und Methodik: Ziel unserer Arbeitsgruppe war die Erstellung spezieller Patientenaufklärungs- und Dokumentationsbögen für Kinderärzte. Bislang herrscht die Praxis, Aufklärungsbögen aus der Erwachsenenmedizin für die Anwendung in der Pädiatrie handschriftlich zu modifizieren. In den vier von uns erstellten und juristisch geprüften Patientenaufklärungsbögen werden die Lumbalpunktion, Anlage eines zentralvenösen Katheters, Leberpunktion sowie die Bronchoskopie ausführlich in einfacher Sprache und kindbezogen beschrieben sowie illustriert. Zusammenfassung: Eine Patientenaufklärung wird seit über 100 Jahren gefordert und ist seit 1951 gesetzlich vorgeschrieben. Seit 1998 ist die spezielle Aufklärung über medizinische Eingriffe an Kindern vom Weltärztebund gefordert. Die von uns angefertigten Patientenaufklärungen stellen den Beginn dar, spezifische Dokumentationsbögen für Kinderärzte zu erstellen, welche anhand dieser Manuskripte im Falle eines Haftungsprozesses eine ordnungsgemäße Patienten- bzw. Elternaufklärung nachweisen können. Wir betonen nochmals, dass Aufklärungsbögen aus der Erwachsenenmedizin weder medizinisch noch juristisch korrekt bei Kindern eingesetzt werden dürfen.
