Son yıllarda mobbing davalarının gittikçe artmasına rağmen kabul edilen mobbing davaları aynı ölçüde artmamaktadır. Mobbing davalarında kabul edilen tazminat taleplerinin az oluşu mobbingin çok iyi bilinmediğini ve yargılama sırasında ispat edilemediğini göstermektedir. Mahkemeler, mobbing iddiasına bağlı tazminat talepleri karşısında iddia edilen olgunun mobbing olup olmadığını değerlendirmekte, mobbingin unsurları yoksa manevi tazminat taleplerini reddetmektedir. Oysa her mobbing olgusu aynı zamanda kişilik hakkının ihlali anlamına gelmekte ve kişilik hakkının ihlali de manevi tazminatı gerektirmektedir. İddia edilen eylemler mobbing oluşturmasa bile kişilik hakkının ihlali sayılıyorsa manevi tazminata hükmedilmelidir. Manevi tazminatın belirlenmesinde belli ölçütlerin göz önünde bulundurulması zorunludur. Bu nedenle hakim tazminatı belirlerken takdir hakkını bilinçli şekilde kullanmalı ve hakkaniyete uygun bir karar vermelidir. Mobbing kişilik hakkının ağır şekilde ihlali olduğundan hükmedilecek tazminat miktarı da diğer ihlallere göre daha fazla olmalıdır.
