Abstract
environmental protectionism by assing a total countrywide ban against fracking in the summer of 2011. This Note discusses the various statutory and regulatory approaches the United States and individual states within the United States have taken. Additionally, this Note highlights the failure to adequately address the severe environmental consequences related to hydraulic fracturing at both the state and federal levels. Furthermore, in Part V, this Note details the legislative and public policy reasons supporting a French-style ban being legislated federally in the United States. Finally, after conducting a thorough comparative analysis, this Note recommends that the United States adopt a federal ban on hydraulic fracturing.
