Abstract
RESUMO: Pretende-se analisar as acoes coletivas transnacionais, que sao uma realidade conhecida em alguns paises como Estados Unidos e Canada e, em breve, desafiarao o Brasil, na Sentenca Estrangeira 8.542, do Equador. Iniciar-se-a analisando o que seriam as acoes coletivas transnacionais e a razao de sua emergencia no cenario internacional. Posteriormente, concentra-se na analise de sua admissibilidade no Brasil, tanto para o ajuizamento de um processo de conhecimento, como para reconhecimento e execucao de um provimento jurisdicional estrangeiro para beneficiar domiciliados no Brasil, nacionais ou nao. Por fim, pretende-se verificar se as previsoes hoje existentes no ordenamento juridico brasileiro seriam compativeis com as recomendacoes internacionais sobre o tema e concluir com uma analise de o que foi analisado representaria alguma transformacao no instituto da coisa julgada. ABSTRACT: This work intends analyzing the transnational collective action, which are a reality very known in some countries as United States and Canada, and, which, soon, will challenge the Brazilian legal order with the Ecuadorian Foreign Decision 8.542. It begins analyzing what such transnational collective actions are and the reason of their emergence in the international scenario. Then, the analysis is concentrated on its admissibility in Brazil, both to filing of a process and to the recognition and execution of a foreign jurisdictional provision for beneficiating people who live in Brazil, national ones or not. Finally, the international recommendations on such thematic are verified and, as concluding remarks, it is done an analysis of what have been discussed, and its influence over the res iudicata.
