Abstract
תקציר בעברית: בעשורים האחרונים הפך עקרון המידתיות לפרמטר המרכזי ביותר בבחינת חוקתיותו של אקט שלטוני או חוק. רשימה זו, שנכתבה בעיקרה בשנים 2013-2012, היא פרק בספר המוקדש לבחינה השוואתית וביקורתית של עקרון המידתיות במספר שיטות משפט - ישראל, גרמניה, קנדה ודרום אפריקה.הפסיקה והדיון האקדמי בישראל מייחסים מעט מאד חשיבות, אם בכלל, למשפט החוקתי בדרום אפריקה, וזאת למרות השבחים שהורעפו עליה ועל אף שישנם טעמים מוצקים המצדיקים פנייה לשיטת משפט זו כמקור השראה והשוואה, ולעיתים לא פחות (ואף יותר) משיטות המשפט אליהן פונים בתי המשפט ואנשי האקדמיה בישראל.הרשימה בוחנת את היישום של עקרון המידתיות במשפט החוקתי הדרום אפריקאי, ובפרט בפסיקת בית המשפט החוקתי. המשפט בדרום אפריקה לא נבחן מנקודת מבט נורמטיבית, אלא בעיקר מנקודת מבט תיאורית, תוך עמידה על הדמיון והשוני בין המשפט הדרום אפריקאי לשיטתנו בישראל. בנוסף, הרשימה כוללת התייחסות קצרה לנושאי רקע, כגון נקודות ציון בהיסטוריה החוקתית של דרום אפריקה, יחסו של בית המשפט החוקתי למיעוטים, ונושאים נוספים.ההחלטה אם לאמץ תובנות מהמשפט הדרום אפריקאי בהקשר החוקתי - כמו כל שאילה חוקתית - דורשת זהירות רבה ותבונה. רשימה זו מבקשת לספק חומר למחשבה ולדיון בסוגיה זו.English Abstract: Only a very few petitions are rejected because they fail to meet the basic criteria of infringement of a right, or the government action in question having a worthy objective. This being the case, and not only in Israel, it is proportionality that becomes the key factor in determining the constitutionality of the action. Hence the study of proportionality is of tremendous importance.The paper, which was written mainly in 2012-2013, is a chapter in a book dedicated to critical and comparative study of the proportionality principle in several legal systems - Israel, Germany, Canada and South Africa.The paper examines, for the first time, the implementation of proportionality in South African Constitutional law, especially in courts. This is not a normative examination, but rather a description of the way proportionality principle and its sub-tests are interpreted in courts, and a comparison to Israeli law.The decision whether to adopt certain insights from South Africa to Israeli law, like any other constitutional borrowing, requires a careful consideration. However, the paper suggests that the South African legal system can be a good source for comparative study, which is usually overlooked in Israeli courts.
