Abstract
Les immunités juridictionnelles au Canada relèvent d’un ensemble bigarré de normes nationales et internationales, législatives et conventionnelles, jurisprudentielles et coutumières. Elles vivent perpétuellement et douloureusement écartelées entre le politique et le juridique, entre la courtoisie et l’obligation. Comme la jurisprudence canadienne et internationale récente le démontre dans le cadre de poursuites civiles pour la torture, le profond malaise des immunités juridictionnelles se solde parfois par le parachèvement de l’injustice et de l’impunité. L’effritement de l’hétérarchie westphalienne exige vraisemblablement la vérification de la vétuste maxime par in parem non habet imperium. À l’ère du constitutionnalisme transnational, les immunités juridictionnelles doivent s’arrimer aux idéaux des normes impératives et la dignité anachronique du souverain doit désormais accommoder la dignité inhérente de la personne humaine. Le rôle du Canada à cet égard sera examiné.
