Arabic Abstract: يناقش هذا المقال ثلاثة من الأبحاث المنشورة في المجلد العاشر من مجلة القانون الدولي والعلاقات الدولية، وهي مجلة علمية محكمة تصدر سنويا عن كلية القانون ومدرسة مونك للشؤون الدولية في جامعة تورنتو. قدمت هذه الأوراق إلى المؤتمر الدولي الأول عن الفظائع الجنسية التي ارتكبت خلال الحرب الأخيرة في ليبيا وكذلك الحرب الدائرة رحاها حاليا في سورية تحت عنوان: ”العنف الجنسي خلال النزاعات الأخيرة في ليبيا وسورية: تحديات حماية الضحايا وملاحقة المعتدين”. عقد هذا المؤتمر في الثامن من شباط/فبراير 2013 في كلية القانون بجامعة تورنتو بمشاركة نخبة من أساتذة القانون الدولي، والناشطين الحقوقيين، والإعلاميين، والعاملين في سلك القضاء الكندي والدولي. تصدر هذا الملف بحث معمق للدكتور حلمي الزواتي، الفقيه القانوني الدولي، داعية حقوق الإنسان، ورئيس اللجنة الدولية للدفاع عن ضحايا العنف الجنسي خلال النزاعات المسلحة، حيث تناول في بحثه التحديات التي تواجه العدالة الانتقالية في ليبيا لملاحقة ومحاكمة المتهمين بارتكاب جرائم جنسية في الحرب الأهلية الليبية الأخيرة. البحث الثاني قدمه الدكتور جون هغان، أستاذ علم الاجتماع القانوني في كلية علم الاجتماع في جامعة نورث وست الأمريكية، والدكتورة جامي روون، الأستاذ المساعد في مركز علم الجريمة والدراسات الاجتماعية القانونية، جامعة تورنتو. بدأ الباحثان هذه الورقة بتقديم لمحة عامة عما يعرفانه عن العنف الجنسي في سوريا وليبيا، مؤكدين محدودية المعلومات المتوفرة في هذا الخصوص، ومدركين التحديات التي تواجهها المنظمات الإنسانية في جمع وتحليل تلك المعلومات. وقدمت الورقة الثالثة والأخيرة الدكتورة فاليري أوسترفيلد، أستاذ القانون الدولي المشارك، والعميد المساعد للشؤون البحثية والإدارية في كلية القانون في جامعة وستيرن أونتاريو. تناولت الدكتورة أوسترفيلد في ورقتها العنف الجنسي الموجه ضد الرجال والفتيان في الصراعات المسلحة، وناقشت الفهم الحالي للعنف الجنسي ضد الرجال والفتيان كجريمة ضد الإنسانية أو كجريمة حرب في إطار القانون الجنائي الدولي، مكتشفة أن هذه المحاكم لم تتعامل مع هذا النوع من الجرائم على قدم المساواة مع الجرائم الأخرى. English Abstract: This article focuses on three research papers presented at “Sexual Violence in the Recent Conflicts in Libya & Syria: Challenges to Protecting Victims & Protecting Accountability,” an international conference held on Feb. 8th, 2013, at the Faculty of Law, University of Toronto. These papers have been recently published in the Journal of International Law and International Relations (JILIR). Dr. Hilmi M. Zawati, an international criminal law jurist, international human rights advocate, and president of the International Legal Advocacy Forum (ILAF), has discussed the challenge of prosecuting conflict-related gender-based crimes under Libyan transitional justice.The second paper, submitted by both Dr. John Hagan, Professor of Sociology and Law at Northwestern University and Co-Director of the Center on Law & Globalization at the American Bar Foundation in Chicago, and Dr. Jamie Rowen, Assistant Professor of Criminology and Socio-legal Studies at the University of Toronto, examines the use of social science to frame international crimes.The third paper, entitled “Sexual Violence Directed against Men and Boys in Armed Conflict or Mass Atrocity: Addressing a Gendered Harm in International Criminal Tribunals” was submitted by Dr. Valerie Oosterveld, Professor of international law, and Associate Dean (Research and Administration), at the Faculty of Law, the University of Western Ontario.
