Abstract
Des analystes et des acteurs sociaux interprètent le principe de précaution comme une règle d’abstention devant le risque environnemental et sanitaire, et demandent de faire de la preuve de l’innocuité d’un produit ou d’une technique une exigence préalable à toute autorisation. La pensée de Hans Jonas est souvent mobilisée pour défendre cette interprétation catastrophiste du risque. L’article montre que la norme de décision proposée par Jonas, désignée comme règle d’abstention n° 1, conduit à une impasse pratique et à la démesure morale. L’exigence de preuve de l’innocuité, règle d’abstention n° 2, n’en est qu’une caricature encore moins défendable. L’étude du problème posé par l’épidémie d’encéphalopathie spongiforme bovine (ESB) confirme empiriquement la fausseté d’une posture confondant la prévention de risques potentiels avec la recherche de la certitude de l’absence de tout dommage ultérieur. Tel n’est pas l’objet du principe de précaution, qui vise des mesures de prévention précoces mais proportionnées.
