Abstract
La présente étude a pour objectif d’évaluer la faisabilité, pratique et juridique, des programmes d’étiquetage visant à informer les consommateurs de l’origine des produits qu’ils achètent. Garant du droit à l’information des consommateurs dans le contexte de libéralisation des marchés, l’étiquetage est plébiscité pour sa capacité à se concilier avec la liberté du commerce. Malgré ce potentiel, plusieurs défis s’opposent cependant à la traçabilité de l’origine des produits au profit des consommateurs. Les difficultés rencontrées participent tant de la mise en oeuvre concrète de programmes d’étiquetage de l’origine que des carences actuelles du droit pour les encadrer, tel qu’il ressort d’une étude comparative du Canada, des États-Unis et de l’Union européenne. L’étiquetage de l’origine des produits soulève également la question de leur compatibilité avec les disciplines du droit international économique – et notamment avec l’ Accord sur les obstacles techniques au commerce – comme en témoigne la récente décision de l’Organe d’appel de l’Organisation mondiale du commerce, dans l’affaire États-Unis – Certaines prescriptions en matière d’étiquetage indiquant le pays d’origine (EPO).
