Abstract

Cet article propose une réflexion sur la prise en compte du droit international des droits de la personne en droit interne canadien. Les auteurs se demandent si les justifications qui sous-tendent l’impératif de mise en oeuvre en droit interne canadien des traités internationaux des droits de la personne ratifiés par le Canada, soit la séparation des pouvoirs et le fédéralisme, sont devenus des prétextes à leur non-incorporation plutôt que l’expression de véritables préoccupations démocratiques. Or, la pratique actuelle consiste à ne pas mettre en oeuvre ces traités sur la base qu’il existe une conformité préalable du droit interne avec le droit international des droits de la personne. Cela permet au gouvernement d’affirmer sur la scène internationale qu’il remplit ses obligations, mais dans les faits, cette mise en oeuvre n’est pas confirmée par les cours internes, de sorte que l’exécutif semble à l’interne ne pas s’estimer lié par les obligations auxquelles il a pourtant librement souscrit. Les cours canadiennes ont été confrontées ces dernières années à l’invocation accrue des traités internationaux sur les droits de la personne. Bien qu’elles se soient montrées réticentes à analyser les fondements de leur mise en oeuvre, elles en ont toutefois grandement relativisé la nécessité. En effet, que les obligations internationales aient été ou non mises en oeuvre, les cours internes leur donnent désormais un effet essentiellement interprétatif et, en pratique, fort variable. Le recours à la jurisprudence des organismes internationaux de contrôle et au droit international coutumier permettrait au droit international des droits de la personne de jouer le rôle qui lui revient en droit interne canadien.
