La doctrine du forum non conveniens, introduite dans le droit international privé québécois par la réforme du Code civil du Québec (CcQ) en 1994, est très fréquemment invoquée devant les tribunaux. Elle fait également l’objet de nombreuses études doctrinales. En dépit de toutes ces réflexions sur le sujet, plusieurs pans de cette « exception déclinatoire » restent encore obscurs ou ne font pas l’objet d’un consensus. Il en va ainsi du caractère exceptionnel du déclin de compétence par le tribunal québécois, de sa qualification procédurale et du délai dans lequel il peut être invoqué ainsi que du sort de l’action lorsque le tribunal fait droit à la demande. Les auteures de cet article se penchent sur ces questions et constatent qu’alors que le Code de procédure civile du Québec (Cpc) pourrait aplanir certaines de ces difficultés, dans sa forme actuelle, il n’en est rien. Elles déplorent que le seul texte actuellement accessible sur la prochaine réforme de la matière, l’avant-projet de loi déposé devant l’Assemblée nationale en novembre 2011, ne lève pas non plus les ambigüités. Elles exhortent donc les rédacteurs de ce qui sera le prochain Code de procédure civile du Québec de combler les silences afin que le principe énoncé à l’article 3135 CcQ y trouve un écho procédural exprès et sans équivoque.
