Abstract
Dans la tradition du droit civil, la réflexion sur les fondements du droit s’est scindée en deux catégories à partir du XIXe siècle : la philosophie du droit a dès lors été délaissée par les juristes au profit d’une théorie du droit, discipline fondée sur les prémisses du positivisme et consacrée à l’étude de la cohérence interne du droit. Ce faisant, la réflexion sur la conception de la justice véhiculée par les textes de droit s’est érodée. De nos jours, la philosophie du droit, une branche de la philosophie politique, connaît un essor spectaculaire dans la tradition anglo-saxonne. Les spécialistes de ce domaine utilisent les outils de la philosophie politique contemporaine pour évaluer les conséquences morales et éthiques du système juridique. Cet article cherche à démontrer la pertinence de l’analyse philosophique du droit civil, et plus particulièrement du Code civil. À titre d’exemple, l’auteure mène une analyse de la notion de patrimoine au sein du Code civil du Québec à travers le prisme des débats de philosophie politique contemporaine au sujet des différentes conceptions de la propriété.
