Afin de remédier à la rigidité de la séparation constitutionnelle des pouvoirs, héritée de l’Acte de l’Amérique du Nord Britannique de 1867, le Parlement fédéral et les législatures provinciales du Canada ont imaginé de se déléguer mutuellement certaines des compétences législatives exclusives que leur attribue la Constitution. Ils s’apprêtaient ainsi à recourir, sur le fondement d’arguments de type managérial ou visant à réaliser une véritable asymétrie politique, à une technique dont le droit comparé des Etats composés offre de nombreux exemples. Tout en condamnant fermement une telle pratique, la Cour suprême du Canada en a admis, sans discontinuer, plusieurs équivalents fonctionnels en jugeant constitutionnelles la délégation oblique et la législation par référence. Une explication de cette apparente contradiction peut être proposée, en reconstruisant l’hypothèse d’une stratégie de la Cour qui, soumise à des contraintes institutionnelles de divers ordres selon qu’est envisagée la période antérieure ou la période postérieure au « rapatriement » de la Constitution canadienne de 1982, s’est ainsi assuré, au détriment des institutions politiques, la maîtrise de l’interprétation de la Constitution.
