espanolLa responsabilidad social empresarial ha ganado terreno en Canada, tal y como ha quedado demostrado en el caso de las companias multinacionales, particularmente en aquellas que laboran en el sector extractivo. En el mes de noviembre de 2014, el Canada adopto una nueva estrategia para promover la responsabilidad social de las empresas, destinada a las industrias extractivas canadienses que se encuentran en el extranjero. Sin embargo, aunque el marco legislativo actual parezca poco vinculante, se han llevado a cabo algunas reformas que han tenido como finalidad otorgarle a la RSE una posicion mas importante en la esfera economica. En este mismo sentido, parece que la jurisprudencia canadiense ha cambiado su orientacion, con el fin de imponer a las sociedades matrices una mayor responsabilidad, facilitando asi el ejercicio de acciones judiciales por parte de las victimas. En ultima instancia, el derecho mercantil canadiense se situa en un conjunto de reglamentos, que se caracteriza por tener una serie de reformas (de una fuerza normativa variable) y que enfatiza la responsabilidad que poseen dichas empresas. EnglishCorporate social responsibility (CSR) is gaining ground in Canada, as revealed by the subject of multinational corporations in the extractive sector. In November 2014, Ottawa introduced Canada’s Enhanced Corporate Social Responsibility Strategy to Strengthen Canada’s Extractive Sector Abroad. Although the legal framework seems quite lax at the present time, several recent reforms have clearly aimed to give CSR a more substantial place in the economic sphere. Similarly, Canadian jurisprudence also appears to be moving the boundaries by imposing a greater liability on parent companies, whilst facilitating access to judicial action for the victims. Ultimately, Canadian business law is in a regulatory continuum characterized by a series of changes, of variable normative value, that expand multinational corporations’ responsibility. francaisLa responsabilite sociale des entreprises (RSE) gagne du terrain au Canada, comme le demontre le sujet des entreprises multinationales, notamment celles qui travaillent dans le domaine extractif. Le Canada a adopte en novembre 2014 une nouvelle strategie de promotion de la responsabilite sociale des entreprises pour les societes extractives canadiennes presentes a l’etranger. Si le cadre legislatif se montre a l’heure actuelle peu contraignant, il n’en demeure pas moins qu’il a connu quelques reformes recentes cherchant, au bout du compte, a donner a la RSE une place plus importante dans la sphere economique. Dans le meme sens, la jurisprudence canadienne semble egalement faire bouger ses pions sur l’echiquier en tentant d’imposer aux societes meres une responsabilite plus grande, tout en facilitant l’acces des victimes aux recours judiciaires. Au final, le droit canadien des affaires est dans un continuum reglementaire caracterise par une serie d’evolutions (d’une force normative variable) qui renforcent la responsabilite de ces dernieres.
