Le droit public français accorde une place relativement mineure au serment. Le statut de la fonction publique ne consacre en effet aucune obligation générale pour les fonctionnaires de prêter serment lors de leur entrée en fonction, à la différence des fonctionnaires allemands, luxembourgeois ou encore belges... Par ailleurs, les titulaires de fonctions électives, des exécutifs locaux au Président de la République, échappent tous à l'obligation de prêter serment au début de leur mandat, ce qui contraste là encore avec les pratiques étrangères, notamment en Allemagne, en Autriche, en Belgique, au Canada, en Espagne, aux États-Unis, en Italie, au Portugal ou au Royaume-Uni. Outre les connotations négatives dont il est auréolé (le serment de fidélité au maréchal Pétain sous le régime de l'État français), la déconsidération du serment en droit public français peut s'expliquer par le système français de la fonction publique. L'ensemble des obligations qui pèsent sur les fonctionnaires est défini par un statut général complété par un statut particulier. En conséquence, l'énoncé des devoirs qui incombent aux fonctionnaires dans la formule du serment s'avère superfétatoire. Par ailleurs, indistinctement soumis aux règles générales de nature législative ou réglementaire, les agents se trouvent ainsi " dépersonnalisés ". Or, la prestation de serment implique justement d'utiliser la première personne du singulier, en disant " je jure... ". Toutefois, la fonction publique subit des transformations, dont l'avenir nous dira si elles sont fondamentales, mais qui, pour l'heure, ne passent pas inaperçues. En particulier, la déontologie, traditionnellement cantonnée aux professions libérales classiques, s'est introduite depuis plusieurs années dans la sphère politique et administrative. Or, le serment fait partie des instruments de la déontologie : en prêtant serment, le fonctionnaire est sensibilisé à certaines règles de comportements, au respect de certaines valeurs. Ainsi le serment pourrait-il connaître un certain renouveau, tant au niveau de son champ d'application (I) que de sa portée (II), en bénéficiant de l'aura dont jouit aujourd'hui la déontologie dans la vie publique.
