French Abstract: Cet article vise a combler un vide important dans la litterature juridique canadienne en elucidant la nature et la portee normative de la proclamation du 6 decembre 1869 et les principes regissant son interpretation. L’auteur analyse le contexte historique menant a l’emission de la proclamation royale ainsi que le texte meme de la proclamation. L’auteur passe egalement en revue les principes generaux de l’effet juridique des proclamations, et, plus particulierement, les effets juridiques de la Proclamation du 6 decembre 1869. Selon les principes ordinaires de l’interpretation ainsi que selon le principe de l’honneur de la Couronne, le libelle de la Declaration doit recevoir une interpretation large et liberale fondee sur son objectif pacifique et conciliateur. L’auteur avance que la Proclamation du 6 decembre 1869 est un texte constitutionnel important qui demeure pertinent, sinon determinant dans l’appreciation des droits civils et religieux des canadien(ne)s habitant le territoire qui constituait autrefois la terre de Rupert et le Nord-Ouest. English Abstract: The article aims to fill an important gap in Canadian legal literature by elucidating the nature and normative scope of the Proclamation of December 6, 1869 and the principles governing its interpretation. The article examines the historical context leading to the issuance of the Proclamation of December 6, 1869 as well as the text of the proclamation. Further, the article analyzes the general principals and legal effects of proclamations and more specifically, the legal effects of the Proclamation of December 6, 1869. According to ordinary principles of interpretation as well as the principle of the honor of the Crown, the wording of the Declaration must be given a large and liberal interpretation based on its peaceful and conciliatory object. The author contends that the Proclamation of December 6, 1869 is an important constitutional text and remains relevant, if not decisive, in the understanding and appreciation of civil and religious rights of all Canadians living in the territory that was formerly Rupert’s Land and the North West.
