Abstract
English Abstract: During the CBAO’s Constitutional and Civil Liberties Section meeting on February 8, 2001, the Chief Justice of Ontario, the Honourable R. Roy McMurtry moderated a panel of engaging speakers discussing the historical significance of the United States Supreme Court decision in Bush v Gore. The Honourable Madam Justice Rosalie Abella of the Court of Appeal for Ontario reviewed the dizzying chronological chain of lawsuits leading to the decision of the US Supreme Court. Renowned US trial lawyer and human rights champion Jerome Shestack commented the impact of the Supreme Court decision in America and abroad. Finally, Peter Hogg, Canada’s pre-eminent constitutional law scholar described the significant instances of judicial lawmaking by the Supreme Court of Canada. The program was thought provoking made possible by the devoted orchestration of Section chair Marya Duckworth. French Abstract: Lors de la reunion de la Section du droit constitutionnel, des libertes civiles et des droits de la personne de l’Association du Barreau canadien de l’Ontario du 8 fevrier 2001, le juge en chef de l'Ontario, l’honorable R. Roy McMurtry, a anime un panel de conferenciers traitant de l'importance historique de la decision de la Cour supreme des Etats-Unis dans Bush v Gore. L’honorable juge Rosalie Abella de la Cour d’appel de l’Ontario a passe en revue la chaine chronologique etourdissante des proces qui ont mene a la decision de la Cour supreme des Etats-Unis. Par ailleurs, l’avocat plaideur et defenseur des droits humains, Jerome Shestack, a commente l'impact de la decision de la Cour supreme en Amerique et a l'etranger. Enfin, Peter Hogg, eminent specialiste du droit constitutionnel au Canada, a decrit les moments significatifs de travail legislatif de la Cour supreme du Canada. Assurement, le programme a suscite de reflexions importantes, le tout rendu possible grâce au travail devoue de Marya Duckworth, presidente de la Section.
