Abstract
English Abstract: With the September 13th shooting of crime reporter Michel Auger of Le journal de Montreal, pressures on Ottawa to invigorate its anti-gang laws are increasing as doubts regarding the effectiveness and constitutionality of s. 467.1 of the Criminal Code continue to linger. At the Civil Liberties Section of the CBAO meeting on November 8, 2000, moderator Morris Manning Q.C. introduced three panelists, Heather Leonoff, Q.C.lead counsel in Canada’s first trial under the present anti-gang legislation, Julian Fantino, Toronto’s distinguished Chief of Police and Yves Lavigne, prolific author and former crime reporter. The panelists unanimously explained, from their own perspective, why s. 467.1 of the Criminal Code is unworkable and necessitates reform. Despite the political motivations behind the speedy enactment of Bill C-95, adopted as a direct response to a very public and bloody war waged in the provinces of Quebec between competing biker gangs, biker gangs continue to thrive three years later. French Abstract: Avec la fusillade du 13 septembre de Michel Auger, journaliste du Journal de Montreal, des pressions accrues sont ressenties a Ottawa pour une amelioration des lois antigang etant donne les doutes qui planent quant a l’efficacite et la constitutionnalite de l’article 467.1 du Code criminel. A la reunion du 8 novembre 2000 de la Section des libertes civiles, le moderateur Morris Manning a presente trois panelistes, Heather Leonoff, avocate principale du premier proces canadien en vertu de la legislation antigang courante, Julian Fantino, chef de police de Toronto et Yves Lavigne, auteur prolifique et ancien journaliste de crime. A l’unanimite, les panelistes ont explique, de leur perspective unique, pourquoi l’article 467.1 du Code criminel s’avere impraticable et necessite une reforme urgente. Malgre les motivations politiques evidentes qui sous-tendent l’adoption hâtive du projet de loi C-95, celui-ci adopte en reaction a la guerre publique et sanglante dans la province de Quebec entre motards, les gangs continuent a prosperer trois ans plus tard.
