The growing worry with the quality of buildings, the high complexity of building construction, the lack of systematic knowledge and of an effective system of guarantees and insurance leads to the need of creating a general legal document for the Portuguese construction or a "Building Code", not only from those involved in the construction process but also of its users. Many countries already have implemented their construction technical documents, so, during the current essay, a study of the French (Documents Techniques Unifiés), Spanish (Código Técnico de la Edificación) and Canadian (Code National du Bâtiment) experiences was carried out. This analysis made possible to synthesize the vast information available in that countries and to reflect of their advantages and disadvantages. As regards the hygrothermic performance of buildings, the moisture is one of the main causes of diseases in Portuguese buildings nowadays. For that reason, this investigation was focused on the design rules of walls against the risk of occurring condensation. Therefore, in an initial phase it was necessary to analyze all the technical French, Spanish and Canadian documentation prevailing for this phenomenon. Then, after the achievement of summaries and reviews explanations, it became possible to structure a proposal for the national "Building Code" in the field of hygrothermic, more precisely of the phenomenon of moisture condensation. The proposal has been accomplished according to an exigencial methodology, defining performance requirements of constructive solutions, so that condensation does not occur.
