La conciliacion sigue siendo un metodo alternativo para la solucion de conflictos que busca que las partes inmersas en el pleito directamente resuelvan el problema en comun que los une con la ayuda de una tercera persona ajena a la naturaleza del percance, quien facilitara un dialogo informal, este mecanismo es reconocido por el ordenamiento juridico para determinados tipos penales que no afectan los derechos e intereses de la comunidad en su conjunto y del Estado. La conciliacion no deja perdedores, es una forma de solucion pacifica de conflictos con evidentes ventajas, tales como: rapidez, economica, eficaz, restaurativa, etc. El origen de la conciliacion se remota a los sistemas juridicos de las primeras sociedades civiles, entre los regimenes legales mas evolucionados de esos tiempos, se encontraba el romano con la Ley de las XII tablas, cuerpo legal que contenia normas regulatorias para la convivencia social, otorgaba fuerza obligatoria a lo que convinieran las partes al ir a juicio, convirtiendose en cosa juzgada o sentencia ejecutoriada; la literatura frecuentemente situa a Ontario, Canada, como el lugar de la primera experiencia de justicia restaurativa, en base que en el ano de 1974 el Mennonite Central Committee introdujo la mediacion penal para resolver algunos casos en el espacio brindado por ciertos tribunales.
