Abstract
Qu’elle continue à jouer un rôle central dans l’établissement de la filiation, comme c’est le cas en France, ou qu’elle n’ait plus qu’un rôle subsidiaire, comme c’est le cas au Québec, la présomption de paternité est aujourd’hui contestée dans la mesure où elle maintient une distinction entre enfants nés dans le mariage et enfants nés hors-mariage que les législateurs des deux États ont cherché à éliminer par ailleurs. Si une partie de la doctrine s’interroge sur l’opportunité de son extension aux couples non-mariés, un nombre important d’auteurs, de part et d’autre de l’Atlantique, estiment qu’il conviendrait de la supprimer purement et simplement et de rompre ainsi avec la logique d’imitation qui soulève d’importantes difficultés lorsque l’enfant concerné est né d’une insémination artificielle dans le cadre d’un couple de même sexe ou encore d’une convention de mère porteuse. L’analyse comparée des droits français et québécois invite ainsi à réfléchir à une nouvelle façon de penser le droit de la filiation.
