L’article 69 de la loi canadienne sur le droit d’auteur prévoit qu’aucun montant n’est exigible d’une personne qui utilise en public un appareil radio, pourvu que ce soit fait dans un endroit, tel un commerce ou un restaurant, où le public est invité à se rendre sans qu’il lui soit chargé un prix d’entrée. Plusieurs pays ont une disposition semblable dans leur législation en matière de droit d’auteur. Cela évite que les détenteurs de droits d’auteur sur des pièces musicales, ou les compagnies de disques, prétendent que le propriétaire de l’appareil radio se trouve à «représenter publiquement» ou à «exécuter publiquement» une œuvre musicale, et doive en conséquence payer des redevances. Mais une telle règle n’est pas sans poser de difficultés juridiques. En 1999, des pays membres de la Communauté européenne ont porté plainte devant l’Organisation mondiale du commerce (OMC), alléguant que la disposition de la loi américaine qui accorde cette exemption n’était pas conforme aux termes de traités signés par les États-Unis en matière de protection internationale du droit d’auteur. À l’été 2000, un ‘‘dispute panel’’ de l’OMC a jugé la plainte fondée en partie, obligeant par ce fait les États-Unis à payer des droits compensateurs, évalués à plus d’un million de dollars, ou à modifier substantiellement leur loi.\nC’est cette problématique que nous voulons étudier ici, à savoir jusqu’à quel point il est légalement possible de faire jouer en public des pièces musicales.
