La Convention pour la prévention et la répression du crime de génocide prévoit que les individus et les États peuvent se voir attribuer une responsabilité pour avoir commis directement ou indirectement des actes de génocide. La décision Bosnie c. Serbie est par ailleurs venue confirmer l’existence d’obligations pour l’État partie à la Convention de 1948 de s’abstenir de prévenir ou de commettre directement ou indirectement un acte de génocide Ainsi, une responsabilité pénale individuelle et une responsabilité de nature civile étatique peuvent cohabiter sous la même convention, a fortiori, pour le même génocide. Depuis les premiers procès pour crime de génocide, de multiples controverses sont survenues quant à l’exigence de la preuve de l’intention spécifique pour ce crime, soit l’intention de détruire en tout ou en partie un groupe national, ethnique, racial ou religieux. Le présent article développe deux aspects du crime de génocide, soit l’attribution de la responsabilité à l’État et à l’individu et l’exigence de preuve de l’intention spécifique. Une brève revue de la Loi sur les crimes de guerre et les crimes contre l’humanité au Canada conclut notre contribution.
