Abstract
대외적 투명성을 제고하기 위한 유형으로는 ① 문서 및 정보의 공개, ② 심리의 공개, ③ amicus curiae brief 제출 허용을 들 수 있다. 우선, WTO 분쟁해결제도는 2002년 “문서의 회람 및 공개를 위한 절차”를 기반으로 선도적인 체제를 갖추고 있다. 판정문 조차도 분쟁당사자의 동의 없이는 공개할 수 없는 ICSID 중재규칙이나 2013 투명성 규칙 이전의 UNCITRAL 중재규칙과 비교해 보면 WTO 홈페이지를 통해 일반 대중이 접근가능한 문서 및 정보의 양은 엄청나다. 한편, WTO에서는 패널과 상소기구에 제출된 분쟁당사국의 서면 입장은 비공개로 취급되나, 대신 공개 가능한 요약문을 제공하도록 하고 있다. 반면, WTO에서 심리의 공개는 분쟁당사국 및 제3당사국의 “의사”에 기반하고 있으며, 2005년 US/Canada-Continued Suspension 사건에서 최초로 패널의 심리가 공개되었다. 특히, 상소 절차에서 심리의 공개가 DSU 규정과의 합치 여부가 논란이 되었으나 상소기구는 DSU 제18.2조 등에 근거하여 심리의 공개를 허용했다. ICJ의 경우는 심리의 공개를 “원칙”으로 삼고 있다는 점에서 선도적인 사례이다. 2006년 개정 ICSID 중재규칙은 분쟁당사자의 반대가 없는 경우 심리를 공개할 수 있도록 함으로써 분쟁당사자의 “동의”를 필요로 했던 것보다 개선되었으며, UNCITRAL 투명성 규칙의 경우는 심리의 공개를 원칙으로 규정하고 있다. WTO 분쟁해결절차에서도 비밀정보 보호를 위한 절차 및 수단 확보를 전제로 심리의 공개에 긍정적으로 접근하는 것이 일반 대중의 신뢰성 확보에 도움이 될 것으로 보인다. 일련의 WTO 사건들을 통해 패널과 자신의 권한을 인정하는데 적극적이었던 상소기구는 대다수 회원국들의 부정적인 반응에 직면하여 실제 amicus curiae brief 취급에 있어서는 소극적인 태도를 보여왔다. WTO 분쟁해결제도는 회원국 간 이익의 균형을 중시하며 일반 대중의 접근 기회는 제3당사국 제도와의 형평성 문제도 야기한다. DSU 개정 협상에서 amicus curiae brief 취급 관련 선진국과 개도국 간 입장차가 팽팽한 이유이다. 그러나 2006년 ICSID 중재규칙과 2013년 UNCITRAL 중재규칙은 amicus curiae brief 제출 허용 여부를 중재판정부의 권한으로 명시하였고, ICJ도 2004년 Practice Direction XII를 도입하여 amicus curiae brief 취급 관련 방향을 제시하였다. 다른 분쟁해결절차에서의 진전 상황은 WTO 분쟁해결제도에서 대외적 투명성을 강화하기 위한 해법 마련에 유용한 참고가 될 것이다.
