L’arret de 2007 Health Services and Support, de la Cour supreme du Canada reconnait le droit de negociation collective en tant que composante essentielle du droit constitutionnel a la liberte d’association tel que garanti par l’article 2d) de la Charte canadienne des droits et libertes. Il s’agit la d’un renversement complet de la jurisprudence anterieure de la Cour, laquelle n’accordait, en 1987, qu’une portee tres limitee a la liberte d’association, denuee de tout impact quant a la sphere du travail : les travailleurs et leurs organisations ne beneficiaient d’aucune garantie specifique au titre de la liberte constitutionnelle d’association, pas davantage par exemple qu’un club de lecture! Cette etude entend analyser, de maniere approfondie, la mise a l’ecart par la Cour supreme de sa lecture anterieure, tres formaliste, de l’article 2 d) de la Charte canadienne, et mettre en lumiere le recours, nouveau en ce domaine, a une approche a la fois instrumentale et axiologique de la liberte d’association. Les critiques formulees a l’encontre du jugement de la Cour supreme, en particulier au sein de la communaute des travaillistes au Canada anglais, sont egalement discutees. Enfin, notamment sur la base du droit international (les conventions de l’OIT en matiere de liberte syndicale), les auteurs etudient les implications previsibles de l’arret Health Services and Support au Quebec dans la perspective de la Charte des droits et libertes de la personne (article 3), y compris au regard du droit de greve.
