EnglishThe motu proprio Mitis Iudex Dominus Iesus and the decision made by Pope Francis to remove compulsory appeal during affirmative causes and the application of the proximity principle lead the Canadian Episcopal Conference to revise the existence of a one and only tribunal of appeal in the whole country that had been set up at the beginning of the century. Before reaching a decision, the members of the Conferences voted for maintaining the statu quo for a year. They face now two options: either a court of second instance for each ecclesiastical regions or such a court for each geographical regions of the Conferences. Since there are only very few formal appeals, it is very likely that the statu quo will remain. francaisLe motu proprio mitis judex et la decision du Pape Francois d’eliminer l’appel obligatoire pour les causes affirmatives ainsi que l’application du principe de proximite a conduit la Conference des eveques canadiens a revoir l’existence d’un seul tribunal d’appel pour tout le pays tel que depuis le debut des annees 2000. Avant de rendre une decision les membres de la Conference ont vote en faveur du statu quo pour une annee. Deux autres option s’offrent a eux: un tribunal de seconde instance par province ecclesiastique ou un tel tribunal dans chacune des regions geographiques de la Conference. Etant donne le petit nombre d’appels formels, Il semble bien qu’on optera pour conserver le statu quo.
