Abstract
The unity of public law contains the papers presented at a conference hosted by the Faculty of Law, University of Toronto, with the title 'The authority of reasons : A new understanding of the rule of law?' The papers / chapters reflect either directly or indirectly on the decision of the Canadian Supreme Court in Baker v Canada (Minister of Citizenship and Immigration) (1999) DLR (4th) 193 (SCC). Baker is an extremely important decision in respect of various aspects of administrative law and has already attracted the attention of the South African Constitutional Court (see Bato Star Fishing (Pty) Ltd v Minister of Environmental Affairs and Tourism 2004 7 BCLR 687 (CC) para 46 n 32). Mavis Baker had entered Canada on a visitor's permit in August 1981 and had been living illegally in Canada ever since, supporting herself by working as a live-in domestic worker for 11 years. She was the mother of four Canadian-born children (and four children born in Jamaica) and suffered from paranoid schizophrenia. In December 1992 the immigration authorities ordered that Ms Baker be deported to Jamaica, her country of origin, from where she could then (theoretically) apply for permanent residence. Upon application for an exemption in terms of section 114(2) of the Immigration Act, it was decided (in April 1994) by the officer involved that there were no humanitarian and compassionate considerations present which would justify a departure from the normal rule regarding applications for permanent residence status (that these had to be made from outside Canada). The validity of this decision was at issue in Baker.
