La monografia, avente ad oggetto uno studio comparativo sulle opinioni dissenzienti presso le corti costituzionali, affronta un tema classico della comparazione, riattualizzandolo alla luce del dibattito scientifico e della giurisprudenza più recente. Da un punto di vista metodologico vengono valorizzate la storia costituzionale e le culture costituzionali. Il lavoro esamina le principali esperienze di common law (Stati Uniti, Regno Unito, Canada, Australia) e dell'Europa continentale (Germania, Spagna, Italia, Francia, oltre agli ordinamenti dell'UE e della CEDU), anche con riguardo alle figure dei giudici (e delle giudici) che più frequentemente hanno fatto ricorso a questo istituto. Nel capitolo conclusivo sono messe a fuoco, attraverso un confronto comparativo, le questioni più importanti sollevate dall'opinione dissenziente: la relazione di tali opinioni con l'interpretazione e l'argomentazione costituzionale; gli stili delle sentenze; i precedenti; il mutamento costituzionale e la canonizzazione del dissent; la certezza del diritto; il diritto o meno del giudice a dissentire; il principio di trasparenza; i processi deliberativi delle corti; la legittimazione delle corti costituzionali.
