Alors qu’un débat de société est en cours sur la question des accommodements raisonnables et qu’il a récemment été jugé nécessaire de modifier la Charte des droits et libertés de la personne pour assurer une protection accrue du droit à l’égalité entre les hommes et les femmes, force est de constater que certaines dispositions anti-discrimination qui existent depuis plus de trente ans en droit québécois sont encore fréquemment bafouées et que leur portée demeure mal définie. Dans le texte qui suit, l’auteure cherche à délimiter l’étendue de la protection offerte par les articles 12 et 15 de la Charte québécoise en matière d’égalité dans l’accès aux biens et aux services ordinairement offerts au public. La première partie du texte est consacrée aux éléments constitutifs d’une discrimination dans l’accès à un bien ou à un service couramment offert au public. Dans la seconde partie, l’auteure s’intéresse aux limites au droit à l’égalité. L’objectif est de définir en quoi consistent une mesure d’accommodement raisonnable et une contrainte excessive en matière de fourniture de biens ou de services. Essentiellement, l’auteure cherche à démontrer qu’en matière d’égalité, la Charte québécoise se démarque tant de la Charte canadienne que des lois antidiscrimination en vigueur dans les autres provinces; tenir compte de cette différence assurerait une meilleure protection du droit à l’égalité, notamment dans l’accès aux biens et aux services destinés au public.
