Abstract
Cet article abordera les procès des femmes accusées du meurtre de leur mari, « petty treason », un crime qui théoriquement frappait le cœur même de l’ordre social et patriarcal, et qui était sujet à la punition atroce du supplice au bûcher. Cependant, nous verrons que les cours de Justice londoniennes pendant les xviie et xviiie siècles avaient tendance en pratique à traiter petty treason de la même manière que n’importe quel autre homicide. Ainsi, la réputation et les circonstances atténuantes telle que la provocation étaient effectivement prises en considération et pouvaient aboutir à un verdict moindre, voire une relaxe. Cette intervention cherche à mettre en lumière l’expérience de toutes les femmes accusées de meurtre conjugal en les plaçant dans un cadre plus large, notamment celui des hommes mis en cause pour homicide entre conjoints. L’accent sera mis sur les rapports entre le genre, le statut social et la crédibilité, les verdicts et les sentences ultimes.
