Abstract
EnglishCitizens ' trust in their institutions is crucial to the functioning of a healthy democracy and good governance. Quebec has created a regulatory framework for lobbying activities that associates its legitimacy through transparency, in the aim of boosting citizens' confidence in public institutions. Adopted unanimously by the National Assembly in 2002, the Lobbying Transparency and Ethics Act recognizes both the legitimacy of lobbying and citizens ' to who is attempting to exert influence on public institutions. In the Act, this right to know is manifested as an obligation for lobbyists to be transparent, such as by recording their activities in the registry of lobbyists. Thus informed of influential communications made in the early part of the public decision-making process, citizens are able to question public office holders before the final decision is made. This paper explains the democratie implications ofthe Act; the conditions for the Act's application as well as the main factors at play in ensuring transparency and ethical conduct; the powers of the Quebec Lobbyists Commissioner; and issues related to compliance with lobbying rules francaisLa confiance des citoyens envers leurs institutions est un enjeu majeur I dans l'exercice d'une saine democratie et d'une bonne gouvernance. Le Quebec encadre les activites de lobbyisme en associant leur legitimite a la transparence afin de renforcer la confiance des citoyens a l'egard des institutions publiques. Adoptee a l'unanimite par l'Assemblee nationale en 2002, la Loi sur la transparence et l'ethique en matiere de lobbyisme reconnait a la fois la legitimite du lobbyisme et le droit des citoyens de savoir qui tente d'exercer une influence aupres des institutions publiques. Ce « droit de savoir » se concretise dans la Loi par l'obligation pour les lobbyistes de faire preuve de transparence, notamment en inscrivant leurs mandats au registre des lobbyistes. Informes des communications d'influence qui sont exercees en amont du processus decisionnel de nature publique, les citoyens peuvent ainsi interpeller les titulaires de charges publiques avant que les decisions soient prises. Ce texte expose les enjeux democratiques de la Loi ; les conditions d'application de la Loi ainsi que les principaux elements permettant de concretiser la transparence et l'ethique ; les pouvoirs du Commissaire au lobbyisme du Quebec et les enjeux de l'adhesion et du respect des regles en matiere de lobbyisme
