Abstract
Si la Cour de cassation vérifie que les juridictions ont pris en compte l’intérêt de l’enfant dans les décisions qui le concernent lorsqu’elles ont le choix entre différentes solutions légales, la gestation pour autrui (GPA) pose problème dans la mesure où elle est prohibée en France, de sorte que, lorsqu’elle a été pratiquée à l’étranger, la reconnaissance de la filiation des enfants à l’égard des parents d’intention est conforme à leur intérêt mais contraire à une disposition d’ordre public. À plusieurs reprises, la Cour de cassation a refusé la transcription des actes de naissance étrangers, tant en ce qui concerne la filiation maternelle que la filiation paternelle. La CEDH ayant condamné la France, l’Assemblée plénière de la Cour de cassation a validé la transcription des actes étrangers établissant la filiation paternelle, mais la transcription de la filiation maternelle demeure interdite, le conjoint du père biologique pouvant toutefois demander l’adoption de l’enfant.
