Abstract
La protection du secret commercial souleve des defi s singuliers. Elle implique une vigilance constante, mais de maniere plus pratique, la mise en place de mesures pour controler qui peut en prendre connaissance et dans quelles conditions. Le regime juridique qui apprehende le secret commercial reste relativement mal connu des entrepreneurs ; le caractere hautement vulnerable du secret n’etant pas saisi, ou les moyens techniques destines a eviter sa perte sont surestimes, de sorte que trop souvent sa sauvegarde est pratiquement soumise a la chance.Les decisions rendues en 2017 en matiere de secret commercial offrent de nombreux exemples de menaces qui planent sur ce genre d’actif intangible. Or, apres avoir explore ces sources jurisprudentielles, nous proposons une selection editoriale portant sur quatre decisions qui presentent le plus d’interet. Pour chacune d’elles, le present article focalise specifiquement sur les aspects du dossier qui concernent le secret commercial, a moins que cela ne tende a denaturer la decision. The protection of trade secrets presents daunting challenges. It requires constant vigilance, but more practically the implementation of active measures designed to control who can have access to said secrets and under what conditions. The relevant legal regime remains poorly understood by entrepreneurs. Also, the highly vulnerable nature of trade secrets is often misperceived and the technical means put in place so as to preserve them are overestimated. As a result, their safeguard is too often left to chance. Many examples when trade secrets have been jeopardized can be found in decision rendered in Canada in 2017. After exploring the case law, we have selected four decisions that are of greater interest.This article focuses on the aspects of each such decision that relate to trade secrets, except where it would alter the meaning or the scope of the decision.
