Abstract
본고는 재한외국인이 취득할 수 있는 체류자격 중 최근 재한외국인의 사회통합을 위하여 활성화하여야 하는 제도로서 주목받고 있는 이민제도에 관한 연구이다. 교통과 통신기술의 발달로 인하여 숨 가쁘게 진행되는 지구촌화, 세계화의 조류 속에 끊임없이 이루어지고 있는 인적·물적 이동, 경제의 발전으로 인한 단순노동분야의 인력난 및 전문영역에서의 우수인재 확보 욕구, 외국인과의 혼인증가, 저출산·고령화 및 인구의 순유출 등으로 인하여 국내에서도 다양한 이민의 수요와 공급이 발생하고 있는 상황이다. 이에 본고에서는 기초적인 연구로서 이민제도의 의의를 살피고, 그 동안 법적 개념에 대한 검토 없이 사용되어 온 이민과 영주권, 이민자의 법적 개념의 정립을 대표적인 이민 국가인 미국과 캐나다의 이민법을 토대로 시도하였다. 또한 미국과 캐나다의 이민제도의 발전과정을 고찰하여 어떻게 사회적 경제적 필요와 사회통합문제를 제도 속에 반영해왔는지를 살펴보고, 미국의 우선순위 제도와 캐나다의 이민심사 점수제도를 소개하였다. 마지막으로, 미국과 캐나다의 이민제도와 정책을 비교하고, 북미의 사례가 우리나라의 이민제도의 정비와 개선에 주는 시사점을 도출하였다.
