Las legislaciones occidentales, especialmente de los paises desarrollados, en la actualidad ya permiten en sus legislaciones el matrimonio entre personas del mismo sexo, asi como varios Estados Europeos, igual en los Estados Unidos de Norteamerica, y, en ciertos de Estados de Latinoamerica. En la primera decada del siglo XXI, hasta el ano 2015; 17 paises, permiten el matrimonio entre personas del mismo sexo, asi tenemos Uruguay, Luxemburgo, Luxemburgo, Argentina, Belgica, Brasil, Canada, Dinamarca, Eslovenia, Espana, Francia entre otros. En nuestra legislacion ecuatoriana, sin embargo, de haber dado pasos significativos para la aceptacion de la homosexualidad en general, con el reconocimiento de la Union de hecho, estable y monogamica entre personas del mismo sexo, existe todavia discriminacion, contra el colectivo GLBTI, no pueden contraer matrimonio entre ellos, vulnerando sus derechos de libertad, igualdad y una vida digna. En tal sentido el matrimonio de personas del mismo sexo, conocido tambien como matrimonio homosexual, matrimonio igualitario o matrimonio gay, constituye un tema juridico de mucho analisis, a fin de garantizar sus derechos, esto es de las personas de diversa orientacion sexual; garantizados por tratados internacionales suscritos por el Estado Ecuatoriano y los principios constitucionales, como el de la igualdad y la no discriminacion. Por otra parte, es importante manifestar, que los derechos de las personas, con relacion a la igualdad, se encuentran amparados por varios Tratados y Convenios Internacionales, asi como tambien por los Principios Universales y Constitucionales como son los principios de igualdad y no discriminacion.
