Abstract
La loi n° 2010-1609 du 22 décembre 2010 a introduit en droit français la convention de procédure participative en créant les articles 2062 à 2068 du Code civil. L'article 7 de cette loi prévoyait une entrée en vigueur des dispositions légales dans des conditions fixées par décret d'application et au plus tard le 1er septembre2011. Cette date ayant été dépassée sans que le Gouvernement n'ait publié le décret d'application, une délicate question d'application de la loi dans le temps se posait (V. CDE 2011, entretien 6, spéc. p. 10). Le décret d'application est finalement paru au Journal officiel du22janvier2012 (V. aussi F. Rongeat-Oudin : JCP G 2012, act. 157). Ce décret codifie trois modes de résolution des différends : la médiation conventionnelle (CPC, art. 1530 et 1531), la « conciliation menée par un conciliateur de justice » (CPC, art. 1536 à 1541) et la procédure participative (CPC, art. 1542 à 1568). Il convient de rappeler que la convention de procédure participative est un mode hybride de règlement alternatif des conflits, puisqu'il mêle intimement négociation et procédure contradictoire, hybridation inspirée par le droit collaboratif dont la pratique s'est développée aux États-Unis et au Canada (V. F. G'Sell-Macrez, Vers la justice participative ? Pour une négociation « à l'ombre du droit » : D. 2010, p. 2450).
