L’arrêt Rendon Marin du 13 septembre 2016 fut pour la Cour de justice de l’Union européenne l’occasion de réaffirmer le principe d’une protection « remontante » attachée à la citoyenneté européenne. Ainsi, le ressortissant d’un pays tiers parent d’un enfant citoyen européen peut-il se prévaloir d’un droit au séjour sur le territoire de l’Union européenne dérivé de celui du mineur. Toute dérogation à ce principe nécessite que le ressortissant étranger présente une menace réelle et actuelle pour un intérêt fondamental de la société qui l’accueille. Nouvelle illustration du contrôle de proportionnalité par la juridiction européenne elle-même, l’arrêt Rendon Marin préfigure également l’arrêt Chavez Vilchez du 10 mai 2017. Au terme de ce cycle jurisprudentiel, le juge national dispose des outils pour procéder au contrôle de proportionnalité à la lumière des dispositions constitutionnelles de l’article 20 du TFUE. La défense des droits fondamentaux en sort renforcée sur le continent européen. Outre la protection offerte par la jurisprudence de la Cour européenne des droits de l’homme, le droit de l’UE propose désormais de vastes possibilités fondées sur la citoyenneté européenne. Celle-ci est appelée à devenir, pour reprendre les termes de la CJUE, le statut fondamental des ressortissants des États membres.
