Abstract
L’article 23 de la Charte canadienne des droits et libertés constitue une disposition vitale pour les minorités de langue officielle du Canada. Devant le peu d’empressement chez plusieurs provinces à mettre en oeuvre les garanties scolaires qu’il octroie, de nombreuses démarches ont été entreprises devant les tribunaux canadiens. Ces derniers ont été appelés à se prononcer sur l’interprétation qui sied à cet article, sur l’identification des titulaires des droits, sur la nature et le contenu des droits conférés, sur la mise en oeuvre effective des droits scolaires et sur les formes de réparation en cas de violation. L’auteur procède à une analyse critique de l’interprétation judiciaire dans ce domaine. Il identifie les principaux défis qui, selon lui, se posent aux minorités de langue officielle et il interroge la pertinence, sinon l’efficacité, du recours judiciaire en la matière.
