La question de la protection de l’environnement est devenue récurrente lors de la négociation d’accords économiques et d’investissements internationaux. Elle a souvent été reliée à la notion d’expropriation indirecte. Or, l’expropriation indirecte est une notion complexe. Elle soulève la question de l’interprétation qui en est faite et, donc, de la définition que lui donne le droit international de l’investissement. Cette étude analysera la notion d’expropriation indirecte telle qu’énoncée par l’Accord économique et commercial global (AECG) et le Partenariat transpacifique (PTP), car ces deux traités illustrent une certaine évolution incrémentale du droit international des investissements, grâce à la présence d’une dynamique entre la pratique arbitrale et la négociation des accords internationaux. Alors que ces traités ont été vivement critiqués par une part non négligeable de la société civile et par une partie de la classe politique, les résultats de ce travail de recherche soulignent qu’il résulte de ces accords un meilleur encadrement de l’expropriation indirecte. Ils établissent un juste équilibre entre la poursuite de politiques légitimes, dont la protection de l’environnement fait partie, et la protection des investissements étrangers. De fait, l’AECG et le PTP énoncent des règles claires et précises au niveau de l’expropriation indirecte qui limitent les interprétations extensives de la notion d’expropriation indirecte et qui garantissent l’exercice du pouvoir réglementaire des États. Toutefois, un certain nombre de failles demeurent persistantes et les parties à l’accord pourraient certainement aller encore plus loin, afin de favoriser de meilleures marges de manoeuvre pour les États, en vue de protéger leur environnement.
